Probate

Probate is the legal process through which a decedent’s assets are administered according to their will or according to state intestacy law.

Probate can be initiated with or without a will. If there is a will, then the named personal representative is responsible for paying the decedent’s debts and distributing their assets according to the will. If there is no will, then an administrator is appointed through the probate process.

Probate can be a complicated and lengthy process, so it is prudent to meet with an attorney to ensure that you minimize the cost and pitfalls associated with the probate process.
